Terms of Service

These Terms of Service (“Terms”) govern your access to and use of OpenDock, a managed hosting platform for open-source applications operated by OpenDock (opendock.cloud).

1. Acceptance of Terms

By creating an account, placing an order, or using any part of the OpenDock platform (the “Service”), you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree with these Terms, do not use the Service.

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to create an account and purchase subscriptions.

2. The Service

OpenDock provides monthly recurring subscriptions for managed hosting of open-source applications, including WordPress, n8n, Supabase, Nextcloud, OpenClaw, and Uptime Kuma. Plans (Starter, Pro, and Business) differ by allocated CPU, memory, and storage, as described on our pricing page.

  • Applications are provisioned and managed through the OpenDock dashboard.
  • Each application receives a subdomain in the form app-name.opendock.cloud. You may point your own domain to your application using DNS.
  • “Managed” means we handle the underlying infrastructure, application deployment, and automated backups. Management of your application’s content, users, and configuration remains your responsibility.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information when creating an account, and keep it up to date. Notify us immediately at hello@opendock.cloud if you suspect unauthorized access to your account.

4. Orders and Payment

All plans are billed as monthly recurring subscriptions. An invoice is issued in advance of each billing period. We currently support two payment rails:

  • BDT via bKash (manual payment): you send money to our bKash number 01600086773 and submit the transaction ID in the dashboard. Our team verifies the payment manually, usually within 30 minutes and always within 24 hours of submission.
  • USD via card: checkout and payment processing for card payments are handled by Paddle, which acts as the Merchant of Record for card payments. Charges appear on your statement from Paddle, and card refunds are processed through Paddle.

Prices are listed on the pricing page and are subject to change with prior notice, as described in Section 13. You are responsible for any taxes applicable in your jurisdiction.

5. Renewals, Suspension, and Deletion

Subscriptions renew monthly. If an invoice remains unpaid by its due date, it becomes overdue and the following timeline applies:

  • A 7-day grace period begins after the invoice becomes overdue.
  • If the invoice is still unpaid after the grace period, your application is suspended (stopped, but your data is preserved).
  • After suspension, data is retained for 30 days with advance email warnings sent to your account email.
  • If payment is still not made after the 30-day retention window, the data is permanently deleted and cannot be recovered.

We never delete your data immediately after a failed payment. Resuming payment during the grace or retention period restores your application.

6. Acceptable Use

You agree not to use the Service to:

  • host or distribute content that is illegal under the laws of Bangladesh;
  • send spam, operate phishing schemes, or distribute malware;
  • run cryptocurrency mining or similar resource-abusive workloads;
  • abuse platform resources (CPU, memory, storage, or bandwidth) beyond normal application use; or
  • engage in any activity that harms the platform, its infrastructure, or other customers.

We may suspend or terminate accounts that violate this section, and may report illegal activity to the appropriate authorities.

7. Customer Responsibilities and Data

While automated backups are taken as part of the Service, you remain solely responsible for your own data, including application content, databases, and configurations. We are not liable for data loss. You can download backups from the dashboard, and we strongly encourage you to keep independent copies of anything important to you.

8. Availability

We target high availability and operate the platform with care, but we do not offer a guaranteed uptime percentage or service-level agreement (SLA) at this time. The Service may be unavailable for maintenance, upgrades, or factors beyond our control. We do not guarantee uninterrupted or error-free operation of the Service.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or free of errors or data loss.

10. Limitation of Liability

To the maximum extent permitted by law, OpenDock and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or business opportunities, arising from or relating to your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us for the Service in the three (3) months immediately preceding the event giving rise to the claim.

11. Termination

You may cancel your subscription at any time from the dashboard to stop future renewals; there is no cancellation fee. Cancellation stops future invoices but does not by itself trigger a refund, as described in the Refund Policy.

We may suspend or terminate your account if you materially breach these Terms (including the Acceptable Use policy) or if required by law. Where feasible and lawful, we will give you notice of the breach and a reasonable opportunity to remedy it.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date on this page and, for material changes, notify customers by email or through the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Bangladesh. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
